A La judge sided with Dodgers pitcher Trevor Bauer on Thursday and denied a 5-year restraining order requested with a lady who stated he clogged her into unconsciousness and punched her frequently during two sexual encounters.
In denying the civil domestic violence restraining order following a four-day hearing, Judge Dianna Gould-Saltman stated that based on the 27-year-old North Park woman’s testimony, Bauer honored her limitations when she set them. And she or he stated Bauer couldn’t be aware of limitations she didn’t express to him.
“We look into an intimate encounter that whenever a lady states no she ought to be believed,” Gould-Saltman stated, “so what don’t let do when she states yes?”
The woman’s attorney, Lisa Helfend Meyer, stated in her own closing arguments that Bauer would be a “monster” who far exceeded exactly what the lady agreed to, particularly in punching her hard and vagina and departing serious bruising which was taken in photographs. Bauer also did stuff that the lady couldn’t accept to because she’d been clogged unconscious, including, based on her testimony, getting rectal sex together with her while she was out, Meyer stated.
“Let me be obvious, the injuries as proven within the photographs are terrible,” stated the judge, who issued her decision about 5 minutes after closing arguments were completed. However, she added, in her own communications with Bauer the lady “was not ambiguous about wanting rough sex within the parties’ first encounter, and wanting rougher sex within the second encounter.”
Bauer didn’t have visible reaction in the court towards the decision.
“We are grateful to the la Superior Court for denying this request,” his lawyer Shawn Holley stated outdoors the courthouse because he was quietly at her side. “We had expected this outcome because the petition was filed in June.”
It had been a victory for Bauer in the public battle to obvious his name, but serious hurdles remain, together with a criminal analysis by police in Pasadena, California, along with a probe by Mlb.
“Allegations made against Trevor Bauer continue being investigated by MLB’s Department of Investigations (DOI) under our Joint Domestic Violence, Sexual Assault and Child Abuse Policy,” the league stated inside a statement following the decision. “We will comment further when needed.”
Major league baseball put Bauer on compensated administrative leave on This summer 2, and it has extended the status through Friday.
The judge reported the criminal analysis earlier Thursday in allowing Bauer to stay from the witness stand in the hearing, following the woman’s attorneys known as him to testify.
Bauer stated “yes, your honor” when Gould-Saltman requested if he meant to follow his lawyer’s advice and invoke his Fifth Amendment to avoid self-incrimination.
Which was the only real time he spoke throughout the four-day hearing.
The lady required the are a symbol of 72 hours of dramatic and emotional testimony, crying frequently she recounted how her excitement and emotional reference to Bauer switched into discomfort, confusion and fear following the two conferences in April and could.
“I felt like my soul left my body system, and that i was afraid,” she stated. “I couldn’t fight.”
At some point she wrapped her very own hair round her neck as she sitting around the witness stand, to exhibit how she stated Bauer had clogged her.
Meyer, who’d no comment outdoors court following the decision, stated during her closing argument that they applauded her client to be “able to endure this monster and perform the right factor.” She added that in her own testimony she “revealed Trevor Bauer for who he is really, for the world to determine.”
But Holley stated in their closing that the objective of the type of order the lady searched for isn’t to create justice or openly expose an individual’s behavior, but to avoid future domestic violence and the 2 people involved apart.
“There isn’t any one in the world who’d think that there’s any possibility that within this existence or the next, in the world or any other, these a couple is ever going to be in any sort of sexual relationship again,” Holley stated.
The judge agreed, stating that Bauer didn’t do anything to pursue or threaten the lady following the second and final time they met personally.
Holley focused through the week on messages the lady delivered to Bauer backward and forward conferences.
“She states it had been a ‘game changer’ when she was clogged out,” Holley stated during her closing argument. “She stated ‘get a few slaps inside.’ She stated ‘I’ve never been more switched on within my existence.’ She stated, ‘Give me all of the discomfort.’”
“She wonders if it’s her fault,” Holley stated. “And she’s to question that.”
The judge reported the messages in her own decision, and stated the woman’s petition for that restraining order, which didn’t include them, was “materially misleading.”
The Connected Press doesn’t typically identify individuals who say they’ve been victims of sexual assault.
